Terms of Service
Effective: January 1, 2026
1. Scope of Services
DigitalContentWorks provides editorial content creation, SEO-optimized writing, copywriting, content strategy, and related digital content services as described on this website. All services are delivered as professional services under French commercial law.
2. Engagement Process
Services are initiated upon written agreement (email confirmation or signed proposal) and receipt of the applicable deposit. Each service engagement includes a defined scope, timeline, and deliverables as outlined in the service description or custom proposal.
3. Payment Terms
Invoices are payable within 14 days of issuance. A 50% deposit is required before work commences on projects exceeding €500. Late payments may incur a 1.5% monthly penalty in accordance with French commercial code (Code de Commerce).
4. Intellectual Property
Upon full payment, all deliverables and their intellectual property rights are transferred to the client. DigitalContentWorks retains the right to display completed work in its portfolio unless otherwise agreed in writing.
5. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This obligation survives the termination of the service agreement by 24 months.
6. Limitation of Liability
DigitalContentWorks shall not be liable for indirect damages, consequential losses, or business interruption. Total liability is limited to the amount paid for the specific service giving rise to the claim.
7. Governing Law
These terms are governed by the laws of France. Any disputes shall be submitted to the competent courts of Versailles, France.
Refund Policy
Effective: January 1, 2026
1. Deposit Refund
The initial 50% deposit is non-refundable once work has commenced. If DigitalContentWorks is unable to deliver the agreed-upon scope due to circumstances within our control, a full refund of the deposit will be issued within 14 business days.
2. Completed Work
Payments for completed and delivered work are non-refundable. Each deliverable is subject to up to two rounds of revisions as specified in the service agreement. Additional revisions may incur extra charges.
3. Cancellation by Client
Clients may cancel an engagement before work has commenced for a full refund minus a 10% administrative fee. Cancellations after work has commenced are subject to payment for all work completed up to the date of cancellation, calculated proportionally.
4. Cancellation by DigitalContentWorks
DigitalContentWorks reserves the right to terminate an engagement if the client fails to provide necessary materials, feedback, or payments within 30 days of the agreed timeline. In such cases, all completed work remains payable.
5. Dispute Resolution
Refund requests must be submitted in writing to [email protected] within 30 days of the invoice date. Disputes that cannot be resolved amicably shall be submitted to the competent courts of Versailles, France.
6. Statutory Rights
Nothing in this policy affects your statutory rights under French consumer law (Code de la Consommation) or applicable EU regulations.
